OPM’s reduction in force regulationsfound in part 351 are published underauthority of 5 U.S.C. 3502(a), whichoriginated in Public Law 78–359 (theVeterans’ Preference Act of 1944). Thestatute provides that OPM’s reduction inforce regulations must give effect to fourfactors in releasing employees: (1)Tenure of employment (i.e., type ofappointment) (5 U.S.C. 3502(a)(1)); (2)veterans’ preference (5 U.S.C.3502(a)(2)); (3) length of service (5U.S.C. 3502(a)(3)); and (4) performanceratings (5 U.S.C. 3502(a)(4)).The proposed regulations clarifylongstanding OPM policy on thecrediting of civilian and uniformedservice for purposes of reduction inforce competition under part 351 of thistitle.These final regulations cover whattypes of service are creditable when anagency establishes the order...
